Confidentiality
A professional commitment to discretion, trust and responsible information handling.
Trust is fundamental to the way PRIMA ELITE works.
Consulting engagements may involve organisational information, internal processes, strategic priorities, operational challenges, commercial information and other material that should not be disclosed beyond authorised individuals.
PRIMA ELITE recognises the importance of treating such information with care and discretion.
5.1 Our commitment
PRIMA ELITE seeks to maintain appropriate confidentiality throughout its professional engagements.
Information received from a prospective client, client, partner or authorised representative will be handled responsibly and accessed only where reasonably necessary for the relevant business or engagement purpose.
The company will take reasonable steps to prevent unauthorised disclosure, access, copying, use or loss of confidential information.
5.2 What may be confidential?
Depending on the circumstances, confidential information may include:
- Business strategies, plans and organisational priorities.
- Financial, commercial and operational information.
- Internal reports, assessments and working documents.
- Project proposals, budgets and contractual information.
- Personal information and information relating to employees, beneficiaries or stakeholders.
- Unpublished research, data, methodologies and intellectual property.
- Access credentials, security information and technical documentation.
- Any information identified as confidential or which reasonably ought to be understood as confidential.
Confidential information may be provided verbally, electronically, in writing, visually or through access to systems, facilities or records.
5.3 How information is handled
PRIMA ELITE aims to:
- Use confidential information only for the purpose for which it was provided or otherwise lawfully authorised.
- Limit access to individuals who reasonably need the information to perform an authorised task.
- Avoid unnecessary duplication, circulation or disclosure.
- Use appropriate technical and organisational safeguards.
- Where contractors or collaborators are engaged, require them to observe suitable confidentiality obligations.
- Where the law or an agreement requires it, notify the relevant client or authorised party of a confidentiality or security incident affecting their information.
- Return, securely delete or retain information according to the applicable agreement and legal requirements.
5.4 Information that is not confidential
Confidentiality obligations generally do not apply to information that the receiving party can demonstrate:
- Was already lawfully known without a duty of confidentiality.
- Is or becomes publicly available through no breach of an obligation.
- Was lawfully received from another source without a confidentiality restriction.
- Was independently developed without using the confidential information.
- Must be disclosed under applicable law, a court order or a lawful regulatory requirement.
Where legally permitted, PRIMA ELITE will seek to limit any required disclosure to the information that must lawfully be provided.
5.5 Client permission and public references
PRIMA ELITE will not knowingly publish a client’s confidential project information, internal documents, unpublished results or identifiable case study details without appropriate authorisation.
The use of a client name, logo, testimonial, quotation, photograph or project reference in public communications requires appropriate permission or another lawful basis.
General descriptions of sectors, capabilities or anonymised engagement experience may be used where they do not disclose protected or identifiable confidential information.
5.6 Confidentiality is not a substitute for an NDA
This page describes PRIMA ELITE’s general professional approach. It is not, by itself, a signed non-disclosure agreement or a complete contractual confidentiality undertaking for a particular engagement.
Where a project involves sensitive, proprietary, personal or commercially valuable information, the parties should agree an appropriate written confidentiality agreement before the information is shared.
A project-specific NDA or service agreement will govern the confidentiality obligations of that engagement where it contains applicable terms.
5.7 Raising a concern
Questions or concerns about the handling of confidential information may be sent to info@primaelite.consulting, with the subject line “Confidentiality concern”.
Please describe the concern without including the confidential material itself. PRIMA ELITE will review it and agree a suitable way to discuss it.
